These Terms of Service (“Terms”) govern your access to and use of the website brainstorming.center/ and any related software, services, workspaces, boards, reports, AI-assisted features, and tools provided by Decision Support Consulting, LLC, located at 4730 University Way NE Ste-104, Seattle, WA 98105, USA & Decision Support Consulting, SRL, located at Bosques de Ciruelos 160-1, Col. Bosques de las Lomas, 11700, Ciudad de México, MEXICO (“Company,” “we,” “us,” or “our”).
By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. The Service
Brainstorming Center is an online collaboration and strategic thinking platform designed to support brainstorming sessions, idea generation, idea grouping, prioritization, strategic analysis, action planning, reporting, and AI-assisted enrichment.
2. Eligibility
You may use the Service only if you are legally able to enter into a binding agreement and your use complies with applicable laws and regulations.
3. Accounts
Certain features require an account. You agree to provide accurate information and keep your credentials secure. You are responsible for all activity under your account.
If you use the Service on behalf of an organization, you represent that you have authority to bind that organization.
4. Subscriptions, Orders, and Billing
Some features may require payment under a free, paid, corporate, enterprise, or other subscription plan. By purchasing a plan, you agree to pay all applicable fees, taxes, and charges.
- Fees are generally non-refundable except where required by law or expressly stated otherwise.
- Subscriptions may renew automatically unless canceled before renewal.
- We may suspend paid features for failed or overdue payments.
5. Permitted Use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Service for your internal business, educational, collaboration, or personal brainstorming purposes.
6. Restrictions
You may not:
- Resell, sublicense, or commercially exploit the Service without written authorization.
- Reverse engineer, decompile, copy, scrape, or attempt to derive source code from the Service.
- Upload malware, harmful code, or unlawful content.
- Use the Service to harass, defame, threaten, deceive, or violate third-party rights.
- Interfere with the integrity, security, or performance of the Service.
- Use the Service in violation of privacy, intellectual property, export, or data protection laws.
- Use the Service to build or train a competing platform without our written consent.
7. Customer Content
You retain ownership of the content you submit to the Service, including text, ideas, files, comments, prompts, images, and session data (“Customer Content”).
You grant us a limited, non-exclusive, worldwide, royalty-free license to host, process, display, transmit, store, and use Customer Content only as necessary to operate, maintain, secure, improve, and provide the Service.
You are solely responsible for Customer Content and for obtaining all rights, permissions, and consents necessary to upload and use it.
8. AI-Assisted Features
The Service may include AI-assisted features that generate ideas, summaries, strategic attributes, recommendations, classifications, and other outputs.
- AI outputs are provided for informational and collaboration-support purposes only.
- AI outputs may be inaccurate, incomplete, biased, or unsuitable in some contexts.
- You are responsible for reviewing and validating any AI-generated output before using it.
- AI outputs do not constitute legal, financial, tax, medical, or other professional advice.
9. Third-Party Services
The Service may integrate with or link to third-party tools, payment processors, identity providers, or other external services. We are not responsible for the content, security, availability, or practices of such third-party services.
10. Privacy
Your use of the Service is also subject to our Privacy Policy.
11. Intellectual Property
We and our licensors retain all rights, title, and interest in and to the Service, including all software, interfaces, designs, workflows, templates, trademarks, logos, documentation, and related intellectual property.
Feedback you provide may be used by us without restriction or compensation.
12. Suspension and Termination
We may suspend or terminate access to the Service if you violate these Terms, fail to pay applicable fees, create security or legal risk, or use the Service in a way that may harm us, other users, or the platform.
You may stop using the Service at any time. Upon termination, your access may be disabled and your data may be deleted in accordance with our retention practices and Privacy Policy.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND AVAILABILITY.
14. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, DECISION SUPPORT CONSULTING, LLC WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS INTERRUPTION.
OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT PAID BY YOU TO US FOR THE SERVICE DURING THE 12 MONTHS BEFORE THE CLAIM; OR (B) USD $100.
15. Indemnification
You agree to defend, indemnify, and hold harmless Decision Support Consulting, LLC and its affiliates, officers, employees, contractors, and agents from and against claims, damages, losses, liabilities, costs, and expenses arising out of your use of the Service, your Customer Content, or your violation of these Terms or applicable law.
16. Governing Law and Venue
These Terms are governed by the laws of the Estados Unidos Mexicanos without regard to conflict of law principles. Any dispute shall be brought exclusively in the federal courts located in Ciudad de México, MEXICO.
17. Changes to These Terms
We may update these Terms from time to time. The updated version will be posted on this page with a revised “Last Updated” date. Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
